Overseas Marriages and Australian Recognition
If you are already legally married overseas, you usually do not need to marry again in Adelaide.
Australia generally recognises an overseas marriage if it was valid where it was celebrated and would not be void under Australian law.
When problems can arise
Recognition can become more complicated if:
- one party was already married
- the parties were in a prohibited family relationship
- there are doubts about whether the marriage was legally valid where it happened
- the paperwork is incomplete or unclear
What documents may matter
You may need:
- the overseas marriage certificate
- an English translation if needed
- identity documents
If you are already married
If your overseas marriage is recognised in Australia, you usually do not need a new Adelaide marriage ceremony.
If you want the legal marriage here and the celebration elsewhere
That is a different situation. Read destination wedding legalities.
Official guidance
For the legal framework, see the official Attorney-General’s Guidelines on the Marriage Act 1961 for authorised celebrants.
